Terms & Conditions
Welcome to Becoming by Unity. These Terms & Conditions govern your use of becomingbyunity.com and your purchase, booking, or participation in services, experiences, products, and other offerings provided by Becoming by Unity, operated by Monana Wellness LLC (“Becoming by Unity,” “we,” “us,” or “our”).
By using this website, purchasing a product, booking an appointment, registering for an offering, or otherwise engaging our services, you agree to these Terms & Conditions and any additional policies or informed-consent documents applicable to the particular service you receive.
If you do not agree with these Terms, please do not use the website, book services, or purchase our offerings.
1. About Becoming by Unity
Becoming by Unity offers several distinct types of services and experiences, which may include:
- Licensed massage therapy;
- Esthetic and facial services;
- Wellness and personal-growth education;
- Guided breath, presence, meditation, and reflective experiences;
- Workshops, circles, community gatherings, and other group experiences;
- Books, journals, audio, digital resources, and educational materials;
- Coaching or personal-development offerings when specifically identified as such; and
- Other wellness-related offerings that may be introduced from time to time.
Not every offering is a healthcare service.
Licensed professional services are provided only within the provider’s applicable Florida license, education, training, and professional scope.
Educational, community, personal-growth, meditation, breath, reflective, and similar Becoming offerings are not substitutes for medical care, mental-health treatment, diagnosis, psychotherapy, physical therapy, or other licensed healthcare services.
2. Massage Therapy
Massage therapy services are individualized according to the client’s stated needs, preferences, relevant health information, assessment findings, consent, and the massage therapist’s professional judgment and scope of practice.
A customized session does not guarantee that every requested technique or area of treatment will be appropriate.
The massage therapist may modify, decline, postpone, or discontinue any technique or service when reasonably necessary for client safety, professional boundaries, contraindications, scope-of-practice considerations, or other professional reasons.
Massage therapy is not a substitute for medical diagnosis or treatment.
3. Facial and Esthetic Services
Facial and esthetic services are cosmetic and wellness services provided within the applicable provider’s Florida professional scope, education, and training.
Services may be customized according to skin presentation, client goals, sensitivities, contraindications, products used, and professional judgment.
Results vary among individuals, and no particular cosmetic result is promised or guaranteed.
Certain skin conditions, medications, allergies, recent procedures, sensitivities, or other circumstances may require a service to be modified, postponed, or declined.
4. Customized
“Customized” means that the service may be individualized within the booked service, allotted time, provider’s training, applicable professional scope, and the client’s needs and consent. It does not mean that the price is determined after treatment.
5. Appointments and Payment
Massage and facial appointments may be booked through our website or approved scheduling system.
A valid payment method may be required to reserve an appointment even when payment for the actual service is collected after the appointment.
Providing a card for booking does not ordinarily mean that the service price will immediately be charged.
The card may, however, be charged in accordance with the cancellation and no-show provisions below when applicable.
Clients are responsible for ensuring that the contact, booking, and payment information they provide is accurate and current.
6. 24-Hour Cancellation & Rescheduling Policy
Your appointment time is reserved especially for you.
We understand that circumstances change. If you need to cancel or reschedule an appointment, please provide at least 24 hours’ notice.
Appointments cancelled or rescheduled at least 24 hours before the scheduled appointment will not incur a cancellation fee.
Late Cancellation
An appointment cancelled or rescheduled less than 24 hours before its scheduled start time will be charged 50% of the scheduled service price.
No-Show
If you do not attend your scheduled appointment and do not provide notice, 100% of the scheduled service price will be charged.
By booking an appointment and providing a payment method, you acknowledge this cancellation policy and authorize Becoming by Unity to charge the card on file for an applicable late-cancellation or no-show fee.
We may make reasonable exceptions when circumstances warrant. Any exception on one occasion does not waive this policy for future appointments.
7. Late Arrivals
Please arrive on time for your appointment.
If you arrive late, we will make reasonable efforts to provide a meaningful service during the remaining appointment time. However, your session may need to end at its originally scheduled time so that subsequent clients are not delayed.
The full scheduled service price remains due when an appointment is shortened because of a client’s late arrival.
If the remaining time is insufficient to provide the service safely or appropriately, the provider will determine whether the appointment can proceed.
8. Client Intake, Health Information and Consent
Clients receiving hands-on professional services may be required to complete an intake form and provide information relevant to the safe provision of the service.
Clients are responsible for providing information that is accurate and complete to the best of their knowledge and for notifying the provider of material changes that may affect their service.
Depending upon the service, clients may also be required to review and sign a separate:
- Massage Therapy Informed Consent;
- Facial/Esthetic Informed Consent;
- Waiver or acknowledgment;
- Photography/media authorization, when applicable and separately requested; or
- Other service-specific consent.
Consent is ongoing.
A client may ask questions, request reasonable modifications, decline a technique or area of work, or ask that hands-on work stop at any time.
9. Professional Boundaries
All massage and esthetic services are strictly professional and nonsexual.
Appropriate draping, professional boundaries, informed consent, and applicable Florida requirements will be followed.
Sexual conduct, sexual requests, harassment, threatening behavior, or inappropriate conduct toward a provider may result in immediate termination of the session.
Florida law specifically regulates sexual misconduct and massage advertising.
10. Age Requirements and Minors
Clients booking independently must generally be 18 years of age or older.
Services for a person under 18 may be considered when appropriate and must be arranged in advance.
A parent or legal guardian must provide any consent required by applicable law and by Becoming by Unity’s policies before services are provided to a minor.
Depending upon the minor’s age, the service requested, and the circumstances, Becoming by Unity may require the parent or legal guardian to remain on the premises or be present during some or all of the appointment.
We reserve the right to decline or postpone a service for a minor when appropriate consent or other necessary safeguards have not been established.
11. Community, Workshops and Becoming Experiences
Becoming by Unity may offer workshops, circles, breath practices, guided experiences, meditations, reflective exercises, community gatherings, and other personal-growth or educational experiences.
These experiences are invitations to awareness, reflection, connection, and personal exploration.
Participants are free to determine what is meaningful or useful to them.
Nothing presented in these experiences requires a participant to adopt a particular spiritual, philosophical, psychological, or personal belief.
Participation does not establish a psychotherapist-patient or physician-patient relationship with Becoming by Unity.
12. Coaching and Educational Content
When coaching or personal-growth services are offered, they are intended to support awareness, reflection, self-leadership, conscious choice, habits, personal development, and related goals.
Unless expressly provided by an appropriately licensed healthcare professional acting within that professional role, Becoming by Unity coaching and educational offerings do not provide diagnosis, psychotherapy, medical treatment, physical therapy, or other regulated healthcare treatment.
Website information, workshops, books, audio recordings, exercises, social-media content, and other educational materials should not be used as a substitute for individualized professional medical or mental-health care when such care is needed.
13. Digital Products, Books and Other Materials
Becoming by Unity may sell or provide books, journals, recordings, meditations, downloadable resources, courses, or other physical or digital materials.
Digital materials are licensed for the purchaser’s personal, noncommercial use unless otherwise stated.
Purchasing or accessing materials does not transfer ownership of Becoming by Unity’s underlying intellectual property.
Specific refund rules applicable to digital and physical products are addressed in our Refund, Cancellation & Rescheduling Policy.
14. Intellectual Property
Unless otherwise indicated, the website and original content associated with Becoming by Unity—including written material, frameworks, exercises, audio, graphics, branding, photographs owned by us, program names, educational resources, workshop materials, and other original content—are owned by or licensed to Monana Wellness LLC.
You may use materials purchased or made available to you for their intended personal use.
You may not reproduce, republish, sell, distribute, commercially exploit, upload, substantially copy, or represent our original materials as your own without prior written permission, except as otherwise permitted by law.
15. Testimonials and Individual Results
Any testimonials or personal experiences appearing on the website represent individual experiences.
They are not promises that another person will experience the same outcome.
Massage, esthetic, educational, personal-growth, wellness, and reflective experiences vary according to the individual and circumstances.
No specific result is guaranteed.
16. Third-Party Services and Links
The website may use or link to third-party services such as scheduling platforms, payment processors, social-media services, maps, email providers, product sellers, or other websites.
Those third parties may have their own terms and privacy practices.
Becoming by Unity is not responsible for the content, availability, security, policies, or independent conduct of third-party websites or services, except to the extent responsibility cannot lawfully be excluded.
17. Electronic Communications and Agreements
By submitting forms, booking electronically, or communicating with us electronically, you consent to receiving communications relating to your inquiry, appointment, transaction, or participation electronically when appropriate.
Florida’s Uniform Electronic Transaction Act provides legal recognition for qualifying electronic records, signatures, and contracts and provides that an electronic record or signature generally may not be denied legal effect solely because it is electronic.
Where we request an electronic acknowledgment or signature, your affirmative electronic action may constitute your agreement to the applicable document, subject to applicable law.
Marketing communications, where used, will be handled separately from necessary transactional or appointment communications and subject to applicable law.
18. Privacy
Your use of the website and our handling of personal information are also governed by our Privacy Policy.
Information collected in connection with professional services may require different handling from ordinary website inquiries.
Please do not submit sensitive health information through a general website contact form unless the form is specifically designated and appropriately configured for that purpose.
19. Right to Decline or Discontinue Services
Becoming by Unity reserves the right to decline, modify, postpone, or discontinue a service when reasonably necessary for:
- Health or safety;
- Contraindications;
- Professional scope or ethical requirements;
- Inappropriate or threatening conduct;
- Sexual misconduct or requests;
- Failure to provide required consent;
- Materially inaccurate information affecting service safety;
- Nonpayment; or
- Other legitimate professional or business reasons.
Any decision involving licensed professional services will be made consistent with applicable law and professional obligations.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Monana Wellness LLC and Becoming by Unity will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, educational content, digital materials, or voluntary participation in nonclinical offerings.
Nothing in these Terms is intended to waive a right or remedy that cannot lawfully be waived, excuse professional negligence where liability cannot lawfully be excluded, or override duties imposed by applicable professional licensing law.
Service-specific risks and informed consent will be addressed separately where appropriate.
21. Changes to Services, Pricing or These Terms
We may update services, prices, website features, policies, or these Terms from time to time.
The current version will be posted on this website with an updated revision date.
Changes ordinarily apply prospectively and do not alter an already completed transaction or existing obligation where applicable law or an existing agreement provides otherwise.
22. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
Any dispute will be handled in accordance with applicable law and any valid dispute-resolution agreement specifically entered into between the parties.
23. Severability
If any provision of these Terms is found unenforceable or invalid, that provision will be interpreted or limited to the extent permitted by law, and the remaining provisions will continue in effect where legally permissible.
